Terms of Service

1. Acceptance of Terms

By accessing or using DFV Digital Hub (the "Platform"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws of the Republic of the Philippines, including but not limited to Republic Act No. 8792 — The E-Commerce Act of 2000, Republic Act No. 10173 — The Data Privacy Act of 2012, and Republic Act No. 7394 — The Consumer Act of the Philippines. If you do not agree, you must discontinue use immediately.

2. Eligibility

You must be at least 18 years old and capable of entering into binding contracts under Philippine law. By registering, you represent that all information you provide is accurate and complete.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. The Platform enforces auto-logout after 3 minutes of inactivity as a security measure. Any activity under your account is your responsibility.

4. Content and Intellectual Property

Authors retain copyright to original works uploaded to the Platform, subject to the non-exclusive license granted to us for hosting, displaying, and delivering content to purchasers. All content is protected under Republic Act No. 8293 — The Intellectual Property Code of the Philippines. Unauthorized reproduction, distribution, or public display of protected content is strictly prohibited and may result in civil and criminal liability.

5. Prohibited Conduct

• Uploading content that violates Philippine laws or contains malware.
• Posting outbound checkout links (e.g., Shopify, Patreon, PayPal) in listings.
• Attempting to bypass content-protection measures (screenshots, screen recording, scraping).
• Sharing purchased content outside the Platform without authorization.
• Engaging in fraudulent transactions or chargeback abuse.

6. Forfeiture Rule

Any listing found to contain outbound payment links or otherwise circumvent the Platform fee structure will be flagged for violation. Upon confirmation, 100% of proceeds from that listing shall be forfeited to the platform treasury and the content may be removed without refund to the author. This is non-negotiable and enforced to protect the integrity of the revenue-sharing model.

7. Revenue Sharing

• Author royalty — 70% of net sale price.
• Admin & supervision — 10% to platform owner (DFV).
• Platform fee — 15% of net sale price.
• System maintenance — 2% of net sale price.
• Affiliate referral — 3% of net sale price (cascading share model).

Payouts are processed in accordance with applicable tax regulations of the Bureau of Internal Revenue (BIR). Authors are responsible for declaring income and remitting applicable taxes.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind. While we employ anti-piracy measures (watermarks, session timeouts, right-click blocking), no system is impenetrable. We are not liable for losses arising from unauthorized access beyond our reasonable control.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising hereunder shall first be subject to mandatory mediation in Makati City. Failing settlement, disputes shall be resolved exclusively by the courts of Makati City.

10. Amendments

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes will be announced via email and platform notice.
