Legal Framework

DFV Digital Hub respects intellectual property rights and operates in compliance with Republic Act No. 8293 — The Intellectual Property Code of the Philippines, the Berne Convention, and the WIPO Copyright Treaty. This policy outlines how we handle copyright infringement claims and protect the works hosted on our platform.

1. Content Ownership

Authors who upload original works retain full copyright ownership. By publishing on the Platform, authors grant DFV Digital Hub a limited, non-exclusive license to host, display, and deliver the content to authorized purchasers. This license does not transfer copyright and terminates if the author removes the content, subject to existing purchaser rights.

2. Anti-Piracy Measures

  • Dynamic watermarking: Every preview and purchased download is embedded with an invisible or visible watermark tied to the buyer's identity.
  • Session enforcement: Auto-logout after 3 minutes of inactivity prevents unattended access.
  • UI hardening: Right-click, text selection, and keyboard shortcuts are disabled inside protected preview areas.
  • Forfeiture rule: Listings with outbound payment links are flagged and 100% of proceeds redirected to the platform treasury.

3. Reporting Infringement

If you believe your copyrighted work has been uploaded without authorization, submit a written notice to our designated agent containing:

  1. Your full name, address, and contact details.
  2. A description of the copyrighted work you claim has been infringed.
  3. The exact URL or product ID of the infringing material on our Platform.
  4. A good-faith statement that the use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  6. Your electronic or physical signature.

4. Counter-Notification

If your content was removed due to a mistaken or misidentified infringement claim, you may file a counter-notification with the same agent. We will restore the content within 10 business days unless the complainant files a court action.

5. Repeat Infringers

In accordance with IP Code provisions and industry best practice, we maintain a policy of terminating the accounts of users who are determined to be repeat infringers. A "repeat infringer" is any user against whom three or more valid takedown notices have been filed within a 12-month period.

7. Criminal Liability Warning

Under Section 217 of the Intellectual Property Code, piracy or the unauthorized reproduction, distribution, or communication to the public of copyrighted works may result in imprisonment of up to three (3) years and a fine ranging from Fifty Thousand Pesos (₱50,000) to One Hundred Fifty Thousand Pesos (₱150,000) for first offenses. Repeat offenses carry heavier penalties.
